Process for licensing a tourism activity depends on nature of business.
First step is to identify which of the four groups of activities
business fits into:
1. Hotels & other accommodation units;
2. Supporting structures to hotels & other accommodations;
3. Public camping & caravan sites;
4. Leisure & tourism complexes.
Then:
Request Information at Local Municipality (pedido de
informação prévia). Process of
obtaining an activity license starts with a visit to Municipality
office where you intend to set up a business. Here you’ll be
informed on relevant requirements for your particular leisure activity.
Local municipality then consults, Directorate General of Tourism (DGT)
and Regional Coordinating Commission, when activity you propose to
explore requires their involvement, as set in corresponding legal
framework.
These entities have 30 days to issue a final conclusion on project.
Consultation period to contest verdict lasts for 8 days after reception
of conclusion at Municipality, after which municipality has 20 days to
issue a final decision on projects viability
Building Permit: request approval of architectural & safety
project of leisure/ tourism activity and supporting infrastructures.
Local Municipality must always consult DGT and local Fire Brigade.
If DGT has reason to issue a negative response to project, it must
notify investor and explain reasons to its conclusions, before
conveying a pronouncement to Local Municipality;
Investor then has 8 days to respond in writing to DGT, which can
advocate intervention of a committee to reevaluate matter. Upon
reception of final decision from respective authorities, Local Council
has a period of 20 days to issue a final declaration on proposal.
Local council will issue a building permit after approval of project in
its detail.
Note: tourism & leisure activity investors must comply with
applicable regulations set out by law to avoid any construction
barriers that might cause difficulty to disabled & special need
citizens.
Permit on Tourism Use (Licença de
utilização turistica): Upon completion of
construction work and when leisure establishment is totally equipped,
whence it is ready to initiate its business activity, investor must
request emission of a Permit to Tourism Use at local municipality.
Permit on Tourism Use license is issued after local council visits
location and inspects site.
Approval Inspection for final classification (Vistoria
aprovação definitiva da
classificação): Investor then has 2 months (after
Permit to Tourism Use license is issued), to request final approval of
classification of tourism activity, which implies a visit from DGT to
inspect site and classify activity.
In such cases where issues on specific circumstances exist, DGT must be
consulted more directly. Some situations that require a closer
involvement include:
a) Building work not subject to municipal licensing permits, but
destined to modify classification or maximum capacity of tourism
activity, or which may undermine minimum requirements for its current
classification, all require authorization of DGT;
b) Building work done to inside of tourism establishment, not subject
to local council licensing, or specific authorization from DGT, must
always be approved by Fire Brigade;
c) Process for setting up restaurants & catering activities is
handed over to local municipalities and approved by them, but is also
regulated by official licensing legal framework for private
construction work, taking into consideration that:
Request for prior information (pedido de
informação prévia), should be
organized under Administrative Rule 1115-B/94, of 15 of December,
presenting documents pertinent to each case. In case of restaurant/
drinking establishments with dancing areas, local municipality must
consult Civil Governor, who in turn has 30 days to issue a
pronouncement on location, public safety and public order aspects. This
pronouncement is final and valid for one year.
If pronouncement is not issued within legal period, it is considered to
be approved.
Period for local municipality to deliberate on request for prior
information is set in Law-decree nº 250/ 94: 30 days counted
from day request is made, or 30 days from reception at municipality of
pronouncement made by Civil Governor, when this is required.
d) Building licensing: request for a construction license must abide by
Administrative Rule 1115-B/94 of December 15, with necessary documents
applicable to each case, bearing in mind following special requisites:
National Fire Brigade pronouncement;
Directorate General for Energy pronouncement, to verify that
electricity fittings abide by necessary safety regulations in such
cases where establishment is a bakery, an ice cream parlor, or another
establishment where cooking is undertaken;
Civil Governor Pronouncement, which acts upon safety aspects and public
order matters in restaurant and other food & drinking
establishments that have dancing rooms or other dancing areas, except
when this pronouncement has already been issued during request for
prior information stage.
Usability License: After construction works have been completed
investor must put in a request to President of Municipality, for issue
of a Usability License.
In subsequent period of 30 days a site inspection is made, after which
President of Municipality has 15 days to deliberate and 8 days to
notify promoter on outcome of decision, and amount due for emission of
Usability License Permit. This permit is used to demonstrate conformity
of construction work with approved project, as well as compliance of
establishment with sanitation norms & fire prevention
regulations.
Classification: Restaurants & other eating establishments can
be classified as “luxury” or as
“traditional”, depending on which requirements are
met as described in respective regulatory guidelines. After presenting
a request for classification of establishment at DGT, a site inspection
is made within 45 days. After this visit, DGT has 15 days to issue its
verdict.
